Contracts based on a framework agreement shall be awarded in accordance with the procedures laid down in paragraphs 3 and 4.

2. Where contracting entities have awarded a framework agreement in accordance with this Directive, they may avail themselves of Article 40(3)(i) when awarding contracts based on that framework agreement.
    3. Where a framework agreement has not been awarded in accordance with this Directive, contracting entities may not avail themselves of Article 40(3)(i).

1. De ændringer vedrørende ingeniørfirmaernes erstatningsansvar, som indklagede ønskede indsat i kontrakterne med Moe og Brødsgaard A/S og Cowi A/S afviger efter deres indhold så meget fra de tilsvarende bestemmelser i den delaftale, som indgik i rammeaftalerne med de 2 ingeniørfirmaer, at indklagede ikke kunne indgå disse aftaler på grundlag af disse rammeaftaler. Indklagede har derfor handlet i strid med Forsyningsvirksomhedsdirektivets artikel 5, stk. 2, jf. artikel 20, stk. 2, litra i, sammenholdt med artikel 20, stk. 1, ved at indgå de 2 aftaler.

Indklagede, Københavns Lufthavne A/S, har handlet i strid med Forsyningsvirksomhedsdirektivets artikel 5, stk. 2, ved at indgå 2 delaftaler med de rådgivende ingeniørfirmaer Moe og Brødsgaard A/S og Cowi A/S, med følgende bestemmelser: a. de rådgivende ingeniørfirmaers rådgiveransvar er uden beløbsmæssige begrænsninger, b. de rådgivende ingeniørfirmaers tilsynsansvar er uden beløbsmæssige begrænsninger, samt c. de rådgivende ingeniørfirmaer er solidarisk ansvarlige med eventuelle medskadevoldere.
