11. Indklagedes skrivelse af 15. juni 2006 er efter sit indhold utvetydigt en meddelelse til de prækvalificerede virksomheder om, at de er blevet prækvalificeret. Da skrivelsen således ikke indeholder en anmodning om at afgive tilbud, tager Klagenævnet ikke påstanden til følge.
