2. However, the Hellenic Republic and the Portuguese Republic may provide that the provisions referred to in paragraph 1 shall apply not later than 16 February 2000.

Nevertheless, the Hellenic Republic, the Kingdom of Spain and the Portuguese Republic shall bring into force the necessary measures so as to comply with this Directive by not later than 1 March 1992.

21. The following Articles are inserted in Title V:
    Article 29a
    1. Until 31 December 1992, this Directive shall not prevent the application of existing national provisions on the award of public works contracts which have as their objective the reduction of regional disparities and the promotion of job creation in regions whose development is lagging behind and in declining industrial regions, on condition that the provisions concerned are compatible with the Treaty, in particular with the principles of non-discrimination on grounds of nationality, freedom of establishment and freedom to provide services, and with the Community's international obligations.
    2. Paragraph 1 shall be without prejudice to Article 29 (4).

However, with regard to the Hellenic Republic, the Kingdom of Spain and the Portuguese Republic, 1 January 1989 shall be replaced by 1 March 1992.

Article 39
    1. Notwithstanding article 35, the 8 % general preference applied in Greece to public contracts shall be progressively eliminated by the Hellenic republic in accordance with the same timetable as that established in article 25 for the abolition of customs duties on imports between Greece and the community as at present constituted.
    2. Notwithstanding article 35, the Hellenic republic may, for two years from the 1 January 1981, postpone opening its lists of approved suppliers to community suppliers.

Nevertheless, in the case of the Kingdom of Spain, 1 January 1993 shall be replaced by 1 January 1996. As regards the Hellenic Republic and the Portuguese Republic, 1 January 1993 shall be replaced by 1 January 1998.

61A2G1-20.2The first point to note is that the Spanish Government has acknowledged that this provision did not correctly transpose into national law the order of preference of the standards by reference to which the technical specifications in public supply contracts are to be defined, as laid down in Article 7(1) of Directive 77/62. The fact invoked by the Spanish Government that that provision was substantially amended by Council Directive 88/295/EEC of 22 March 1988 amending Directive 77/62/EEC coordinating procedures for the award of public supply contracts and repealing certain provisions of Directive 80/767/EEC (OJ 1980 L 127, p. 1), which granted the Kingdom of Spain an additional period for its implementation, is not such as to justify that acknowledged failure to fulfil its obligations. In any event the period prescribed for the transposition of Directive 88/295 into Spanish law expired on 1 March 1992.
